Federal Judge Orders Freedom of Abrego Garcia from Immigration Detention

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without legal authority.

"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her ruling.

The case stems from a mistaken deportation to El Salvador earlier this year, which the government later admitted was an mistake. After his repatriation to the United States to answer alien smuggling charges, he was held in federal custody.

In her order, the judge noted that the authorities lacks a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

Background of the Case

The court proceedings center on disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a ongoing trial in the state of Tennessee.

Terms of Release

The court, who was overseeing his petition to removal in a federal court, ruled that he must now adhere to the conditions of his bond from jail in Tennessee. This order effectively transfers his supervision to the Tennessee court.
